This Court vide order dated 18.09.2009 had forwarded the matter to the
Mediation and Conciliation Centre of this Court since it relates to matrimonial
dispute between the parties, which arises out of case crime no. 11 of 2009,
under Sections 498-A, 323, 504 and 506 IPC read with Section 3/4 Dowry
Prohibition Act, police station Mahila Thana, Hazratganj, district Lucknow.
There is a report of Mediation Centre dated 08.12.2009 on record from which
it transpires that mediation between the parties has failed .
We have also gone through the FIR, which discloses commission of
cognizable offence and, as such, the same cannot be quashed.
The writ petition is misconceived and is accordingly dismissed.
Interim order granted earlier stands vacated.
