Rule.

Learned APP Ms. Shah waives service of rule for respondent State.

Counsel
for respondent no.2 original complainant tenders affidavit dated
16.7.2010 which is taken on record. Counsel for the parties submitted
that there has been settlement between the petitioners and the
complainant. Complainant does not wish to press charge any longer.
This has also been stated in above-mentioned affidavit.

Considering
the allegations made in the complaint, considering the nature of
dispute between the parties emerging from complaint as also
considering the development that the issues have been settled as
stated by counsel for the parties as well as in the affidavit of the
complainant, I am of the opinion that no useful purpose would be
served in permitting further trial into complaint Annexure-A,
pursuant to which charge-sheet is also filed.

In
the result complaint Annexure-A being C.R. No.I-293/2004 registered
before Satellite police station and all subsequent proceedings
arising thereof are quashed.

Petition
is disposed of. Rule made absolute accordingly.

Direct
service is permitted.
