03. 28.01.2011 Heard learned counsel for the petitioners and the state.
A mob stopped petitioners’ truck demanding appearance of
administration. Finding delay, petitioners are alleged for indiscriminate
firing causing injuries to four persons from the mob. Submission of the
learned counsel for petitioners is that a counter case is also there filed on
behalf of the petitioner no.1 for the occurrence of the same day followed
by an earlier case bearing Dalsingsarai P.S. Case No.148 of 2010.
Specifically it is submitted that petitioners were brutally assaulted
causing grievous injury and alleged injuries caused by petitioners are of
simple nature caused by hard and blunt substance, save and except, of
Raj Kumar and Prem Kumar Paswan one each, which are reserved for
its opinion for its nature and weapon used.
Having regard to the facts and circumstances of the case, in
the event of arrest or surrender within a period of one month from the
date of receipt/production of a copy of this order, the above named
petitioners shall be released on bail on furnishing bail bond of
Rs.10,000/- (ten thousand)each with two sureties of the like amount
each to the satisfaction of the Additional Chief Judicial Magistrate,
Dalsingsarai in connection with Dalsingsarai P.S. Case No.149 of 2010,
subject to the conditions as laid down under section 438(2) of the Code
of Criminal Procedure.
