Present application has been filed for cancellation of bail
granted by High Court on 14.7.2008 in case crime No. 33/-8,
under Section 307 IPC, P.S. Cholapur, District Varanasi.
List revised. None present for the applicant except learned
A.G.A.

Heard learned A.G.A. and perused the record.
Ground for cancellation of bail is that the applicant has
concealed the criminal history hence the bail application was
allowed.

From perusal of the order dated 14.7.2008, it is clear that the
bail application was not allowed on the ground that there was
no criminal history. It is not mentioned that the contention of
the learned counsel for the applicant was that there was no
criminal history. In fact the role of firing was assigned to co-
accused Ram Kishan and not to the accused-opposite party
No.2. Hence the bail application was allowed.
Considering the aforesaid fact, without observation on merit,
at this stage, it is not a fit case for bail.
Accordingly, present bail cancellation application is hereby
rejected.
