4. 17.08.2011 Heard learned Counsel for the parties.
Annexure ‘B’ to the show cause filed on behalf of Opposite
party no. 4 is a communication addressed by it to the petitioner in
pursuance of the directives of Ministry of Health and Family Welfare
requiring the petitioner to fill up the standard information form to enable
the matter to be processed further with regard to recognition.
Counsel for the petitioner fairly acknowledges that the required
information was not furnished within 15 days as mentioned therein and
that the petitioner requires some further time to comply.
If the petitioner has himself not been alert for compliance of
the order within the time fixed by the Court it is difficult to question the
opposite parties for any flouting of the orders of the Court.
Suffice it to observe that if the petitioner requests for extension
of time, though the discretion shall rest with the opposite parties to be
exercised in accordance with law, the Court only expects them to act
reasonably and not rigidly.
The MJC application stands disposed.
