The petitioners, who are students of United Institute of
Management, Allahabad which is affiliated to Chhatrapati Shahu Ji
Maharaj University, Kanpur (hereinafter referred to as the
‘University’) have been declared failed in the back paper
examination of Second Semester in the Bachelor of Business
Administration Course. The relief claimed by the petitioners is for
a direction upon the respondents to conduct the Special Back
examination for the Bachelor of Business Administration Course,
Second Semester.
Sri Neeraj Tiwari, learned counsel appearing for the respondent-
University states that the petitioners may approach the Vice-
Chancellor of the University for holding of the Special Back
Examination and the Vice-Chancellor shall consider the request in
the light of the relevant Ordinances of the University.
In view of the aforesaid, the writ petition is disposed of with a
direction that in the event the petitioners file a representation along
with the certified copy of this order within a week before the Vice-
Chancellor of the University, an appropriate order shall be passed
by the Vice-Chancellor of the University in accordance with the
relevant Ordinances of the University within two weeks from the
date of filing of the representation.
It is made clear that the Court has not adjudicated upon the merits
of the case which shall be examined by the Vice-Chancellor of the
University in accordance with law.
