Counter affidavit has been filed on behalf of the complainant,
which is taken on record.
Heard learned counsel for the applicant, learned A.G.A. appearing
for the State and Sri H.K. Sharma, learned counsel for the
complainant.
It is contended by the learned counsel for the applicant that the
applicant was on bail in this case but did not appear before the trial
court and this was the reasons that he was again sent to jail and is
in jail since 10.4.2010.
Learned AGA has not disputed this fact.
Considering the facts and circumstances of the case and
submissions made by the learned counsel for the applicant and
without expressing any opinion on the merits of the case, the
applicant is entitled to be released on bail.
Let the applicant- Sarjeet Singh, involved in Case Crime No. 223
of 2010 under Sections 498A, 304 IPC and 3/4 D.P. Act, Police
Station Dadari, District Gautam Budha Nagar be released on bail
on his furnishing a personal bond with two sureties each in the like
amount to the satisfaction of the court concerned with the direction
that the applicant shall appear before the trial court regularly on
the date fixed, in case of default, the court shall take appropriate
action against the applicant and he will not be entitled for bail
again.
