ORDER

By
way of this petition, the petitioners have prayed to quash and set
aside the impugned award dated 14.09.2009 passed by the Labour Court,
Ahmedabad in Reference [LCV] No. 494 of 1993, whereby the Labour
Court has directed the petitioners to pay Rs.40,000/- to the
respondent towards compensation.

The
amount involved in this petition is less than Rs.50,000/-. It has
been the consistent practice of this Court not to enter into the
merits of those matters, wherein, the claims are petty claims. Claims
below Rs.50,000/- have been quantified as petty claim by the Division
Bench of this Court. Hence, this petition is not entertained on the
ground that it involves a petty claim. This order may not be treated
as precedent in future cases since it has been passed looking to the
smallness of the amount and not on the merits of the case.

In
view of the above, the petition is dismissed. However, it is
clarified that if cross petition is filed by the respondent workman,
it will be open for the petitioner to revive this petition.
