Heard learned counsel for the applicant and Sri Anil Singh Jadaun,
who has put in appearance on behalf of respondent. He prays for
and is allowed three weeks’ time to file counter affidavit.
The applicant shall have two weeks thereafter to file rejoinder
affidavit.
List for admission after expiry of the aforesaid period.
Considering the facts and circumstances, ejectment of the
applicant in pursuance to the impugned judgment shall remain
stayed subject to the condition the applicant deposits entire
decretal amount within a period of two weeks from today and shall
also go on depositing a sum of Rs.1100/- per month as determined
by the court below for use and occupation. Needless to say that
any amount already deposited towards decretal amount shall be
liable to be adjusted. In case of default, this order shall stand
automatically discharged.
