K.M.Joseph, J.

The prayer in this writ petition is to issue a writ of

Habeas Corpus directing respondents 2 to 8 to produce the

son of the petitioner before this Court.

2. Today when the matter came up we heard the

learned counsel for the petitioner and learned Government

Pleader. The alleged detenue was present before us. When

we questioned him, he would say that he was not under

detention of respondents 6 to 8 which is the allegation in the

writ petition. Admittedly, the alleged detenue is aged 22

years and he is a major. Learned counsel for the petitioner

submits that there is a marriage in the temple with the

daughter of 8th respondent who is a minor.

In view of the fact that there is no detention as

such as alleged, we do not propose to permit the petitioner to

WPCRL.384/2009 -2-

pursue the writ petition. The writ petition is closed.
