The Haryana Staff Selection Commission advertised 19
posts of Machinist Mechanic Instructors in the Department of
Industrial Training and Vocational Education. Two posts were
reserved for SC-A and one post was reserved for SC-B. The
essential qualifications prescribed for the posts were (i) Matriculation/
Senior Secondary/10th pass under 10+2 Scheme, (ii) National Trade
Certificate and Craft Instructors Training Course in concerned Trade
coupled with five years Practical/Teaching experience, including the
period mentioned at clause (ii) above from a reputed Industrial
concern or recognised Institute. Knowledge of Hindi up to Matric was
one of the essential qualification.
The petitioner applied for the post and was called for
interview. The result of the selection was declared on 25.12.2006.
The petitioner was placed in the waiting list of the Scheduled Caste
category. Subsequently, the petitioner claims to have made enquiries
and later learnt that the application forms submitted by the
Civil Writ Petition No.7866 of 2011 :2:
respondents, who were selected, did not indicate that they had the
requisite experience. What was endorsed on the applications of the
respondents was that they did not have the experience from a
reputed Industrial concern. The respondent-Selection Commission,
however, found that the respondents carried the requisite experience
from the reputed Industrial concern and were selected. The selection,
which was made in the year 2006 is now being challenged on this
precise ground after lapse of five years. It was for the respondents to
appreciate what sort of experience was needed for the post as they
had prescribed the same. No case for interference at this belated
stage in the selection is made out.
The writ petition is accordingly dismissed.
