ORDER

The
present appeal as well as application for condonation of delay and
another application for bail all arise against the judgement and
order dated 16.02.2010 passed by the learned Sessions Judge for
conviction of the applicant in Sessions Case No.30/09.

Office
has made submission and Mr. Pathak, learned counsel for the
applicant/appellant does not dispute the said position that the very
applicant-convict had already preferred appeal being Criminal Appeal
No.856/10 before this Court against the order of conviction and the
appeal has been admitted by this Court on 05.08.2010.

Under
these circumstances, neither the present appeal against the order of
conviction nor the application for condonation of delay or for bail
can be entertained. Hence, all are disposed of accordingly.
