1. Present
civil application has been filed seeking condonation of delay of 380
days in filing the application for bringing the heirs of respondent
No.14 on record.
2. Having
heard the learned counsel Mr. R.C.Kakkad for the applicant and Mr.
Sejpal for the opponents and having considered the grounds of delay
set out in the application, delay has been explained sufficiently.
Further, in view of the guidelines for grant of delay and in view of
the judgment of the Hon’ble Apex Court reported in AIR 2000 SC
2306 in the case of State of Bihar & Ors. v.
Kamleshwarprasad Singh and Ors., the present application
deserves to be allowed and accordingly stands allowed. Delay of 380
days caused in filing the application is condoned. The prayer in
terms of para 3(B) is granted. The learned Advocate is instructed to
carry out necessary amendment.
3. Rule
made absolute accordingly.
