After the order was passed in connected W.P.(C) No. 3887
of 2010, today, Mr. Sen, learned counsel for the petitioner, confined
this case with the contention that the respondent no. 6-M/s Sunrise
Road Lines and Construction and respondent no. 7-Mr. Suresh Kumar
Sao have been awarded the work against Tender Notice No. 2 of
2010-11 and 3 of 2010-11, though they were not technically qualified.
Referring to the Minutes dated 27.7.2010, he submitted that several
important terms and conditions of the Tender were given go by in
giving work to them.
On the other hand, learned Advocate General pointed out
that vague and general allegations are being made by the petitioner,
who is an unsuccessful tenderer. He produced the original records of
the tenders in question.
On perusal of the records, it appears that respondent no.
6 and respondent no. 7 were selected as they were found eligible
and their rates were also found lowest. I am satisfied that the
tendering process, needs no interference.
In the result, this writ petition is dismissed. However, no
costs.
