The petitioners have sought quashing of the cognizance

order dated 6.1.2010 passed by the Sub-Divisional Judicial

Magistrate, Masaurhi, in Bhagwanganj P.S. case no.67 of 2009, on

the ground that the final report was submitted in the matter and,

therefore, the Magistrate concerned should not have differed with the

same.

It is well within the power of the Magistrate to differ with

the final report.

The application is, thus, dismissed.
