ORAL
ORDER

(Per
: HONOURABLE MR.JUSTICE D.H.WAGHELA)

Hearing
of the appeal is adjourned from time to time on account of absence of
one or the other advocates. It was stated at the bar that out of all
the respondent-workmen concerned, all but two workmen have
practically settled their dispute with the appellant and the appeal
survives only for respondent No.1 (iii) Shantilal Gordhan and
respondent No.1 (viii) Keshu Vija. Learned counsel Mr.Bhushan Oza,
who appeared for these two workmen, stated that they have taken the
papers of the matters from him and he is not in receipt of any
instructions from them thereafter. Therefore, he is not in a position
to assist the court and represent those two workmen. Under the
circumstances, office is directed to issue NOTICE
for final hearing of the appeal to the aforesaid two workmen making
it returnable on 10.05.2011.

The correct current addresses of the aforesaid two respondents being
not available on record, the appellant is directed to serve them
directly. Name of Mr.Bhushan Oza may be deleted from the appearance.
Direct service.
