Heard
Mr. Neeraj Soni, learned AGP for the applicants, and Ms. Puja Dave
for Mr. Pinakin M. Raval, learned Advocate for the opponent.

In
view of the reasons mentioned in the application and also the
statement made by the learned AGP that because of pendency of the
litigation, the opponent-petitioner is continued in service, final
hearing of the main matter may be expedited, the present Civil
Application deserves to be allowed. The prayer in terms of
paragraph-7A is granted. The present Civil Application is,
accordingly, allowed. The main matter, being Special Civil
Application No.5844 of 2004, is ordered to be placed for final
hearing on 6th October, 2008.
