BACKGROUND:

           The Appellant, Shri Kedar Prasad Maheshwari vide his RTI Application dated
     23.02.2009 has requested for the following information:


     i)    Whether the freight incentive scheme is available for loading of coal from
           N.F.Railway in covered wagons only.
     ii)   Whether the scheme of freight incentive is also available for loading of coal
           form N.F.Railway in open wagons only.
     iii) This freight incentive scheme which was valid for three years has been
           further extended or not.


2.         The PIO replied to the RTI Application on 5/3/2009. Appellant has not filed
first appeal to the FAA under RTI Act 2005. According to the Appellant the reply
received from Railway Board dated 5/3/2009 is incomplete, evasive and insufficient.
The Appellant filed the second appeal before the Central Information Commission on
16.3.2009.


3.         The Bench of Mrs. Omita Paul, Information Commissioner, heard the matter
on 23.06.2009.


4.         Mr.V.K.Samuel (APIO III), Mr. Navin Kumar (PIO) and Mr. J.P.Mehta
(SO/RTI) represented the Respondent


5.         Neither the Appellant nor his representative was present.


Decision
               The Commission heard the Respondent. Reply has been sent by the
Respondent to the Appellant giving all the information sought for vide its letter dated
2/4/2009. On examination, The Commission found the information provided to the
Appellant adequate. The case is thus disposed off.
          Announced on conclusion of the hearing.
          Notice of this decision be given free of cost to the parties
          .
