Facts

:

1. The appellant was heard through audio conferencing on 26/12/2008.

2. The appellant has grievances relating to service matters, mainly his
promotion. In this context, he has sought for information through different
applications. Being not satisfied with the responses, he has filed at least four
separate appeals, which are examined together for the sake of convenience.

3. The appellant mentioned that he has asked for inspection of records
relating to DPC proceedings. He has also sought to know as to why he has not
been promoted so far.

4. The CPIO has replied, with which the appellant is not satisfied. During the
hearing, the appellant pleaded for access to the DPC proceedings containing the
details of benchmarks for promotion of staff.

Decision:

5. The process of selection and promotion of staff should be fair and
transparent. Accordingly, this Commission has observed in a number of appeal
cases that the DPC proceedings should be put in public domain, to demonstrate
the objectivity and fairness in the process of recruitment and promotion of staff.

6. The CPIO is, therefore, directed to provide a copy of the DPC proceedings
as asked for by the appellant and also state the reasons on the basis of which
the appellant could not be promoted. The information should be furnished within
15 working days from the date of issue of this decision.

7. As there are no provisions under the Act to redress the grievances of the
employees of the public authorities, the appellant is advised to seek legal remedy
in the matter.

8. All the appeals are thus disposed of.
