Facts

:

1. The appellant did not avail of the opportunity of personal hearing on
22/10/2008. The appeal is, therefore, examined on merit.

2. The appellant has asked for certain information relating to police action
initiated against an employee of the respondent, who is identified in his
application for information.

3. The CPIO has refused to furnish the information u/s 8(1)(j) of the Act, on
the ground that the disclosure of the details of the action taken against the
concerned employee by the employer and the police is not in the public interest.
The appellant has, however, pleaded that the information asked for should be
provided to him.

Decision:

4. The respondent has initiated disciplinary action against one of its
employees under the Service Conduct Rules. The appellant has, however, not
indicated as to how he is affected in the matter or as to what is the public interest
in disclosure of information relating to the alleged criminal case, which is handled
by the police. In view of this, denial of information u/s 8(1)(j) of the Act is
justified.
