Facts

:

1. Both the parties were heard today, i.e. 6th May, 2009.

2. In the course of hearing, the details of information asked for and the PIO’s
response were discussed. The PIO stated that a part of the requested
information, mainly verification reports could not be furnished as the same were
not available in the records.

3. The appellant contended that the PIO was hiding the relevant facts which
pertains to the irregularities committed by a few officials including the mis-use of
reservation policy for recruitment of ex-servicemen. He contended that for
malafide reasons the information was refused to him.

Decision:

4. The PIO’s statement that verification certificates in question are not
traceable, is not acceptable. The PIO is therefore directed to search and trace

the relevant documents or provide the gist verification report on the basis of
which the allegations against some employees were proved or disapproved. The
appellant should also be provided access to entire documents for inspection so
as to enable him to identify and specify the required information.

5. As pleaded by the PIO, the case is remanded back to the respondent for
providing a point-wise response within one month from the date of issue of this
decision. If the appellant is not satisfied with the PIO’s response, he would be
free to approach the Commission again.

6. The appeal is thus disposed of.
