Background

Sh. Rajesh Verma, the complainant, vide his RTI application dated
5.05.2009, sought information regarding the implementation of circular no. 7/2007
dated 23.03.2007, issued by the Commissioner of Police, in matters connected
with Dowry harassment cases. Sh. Sajay Kumar Jain, PIO/S-E Dist., Delhi vide
his letter dated 9.06.2009, provided point-wise reply to the complainant.
However, Sh. Rajesh Verma has filed the present complaint before the
Commission alleging that wrong information has been provided by the PIO.

2. The matter was heard on 8.01.2010

3. The appellant was not present for the hearing.

4. Sh. Pawan Kumar, ACP/SE and Sh. Arun Tyagi,. S.I. represented the
respondent.

In his written representation, the complainant has quoted ‘The Dowry
Prohibition (maintenance of lists of presents to the bride and bridegroom) Rules,
1985’, wherein it is provided that lists of presents, which are given at the time of
marriage to the bride and the bridegroom, shall be signed by bride and
bridegroom. In this regard, the complainant has attached with his complaint a list
of the dowry articles maintained by the bride, which has only been signed by the
bride and the same was provided to the police by the bride in the dowry
harassment case. On the basis of this document (list of dowry articles), the
complainant alleges that Sh. Sanjay Kumar Jain, the PIO has provided wrong
information by saying that the circular of Commissioner of Delhi is being
followed by Delhi Police, regarding the investigation of cases under Section 498
IPC and dowry harassment cases.

Decision

In view of the above the case is remanded back to the First Appellate
Authority with the directions that keeping in view the dowry prohibition rule and
the circular of Commissioner of Delhi Police, the matter may be decided whether
false information has been provided to the complainant or not. The order of the
Commission may be complied with, within 30 days of receipt of this order.

The matter is disposed off accordingly.
