Background
Vide an RTI application dated 30.06.2009, the appellant Sh. Ranbir Singh of
Hari Nagar, New Delhi requested for photo copy of the compliant made by the RWA,
Green View Apartments against him. The ACP, West Delhi cum CPIO, did not
accede to this request for information on the ground of it being 3rd party
information. The appellant then filed appeal dated 24.07.2009 before the First
Appellate Authority (FAA), who through his order dated 24.08.2009 upheld the
decision of the CPIO, while also taking shelter under clause 8(1)(j) of the Act. Not
satisfied with the response of the FAA, the appellant has filed a complaint before
the Commission.
2. The matter was heard on 26.11.2009.
3. Sh. Ranbir Singh, the appellant accompanied by Sh. Satpal Chatrath.
4. Sh. Milind Dumbere, ACP/Tilak Nagar and Sh. Prabhat Kumar, Sub-
Inspector represented the respondent.
During the hearing the appellant submits that he has been summoned by
the Police several times in regard to the complaint filed against him. In absence of
a copy of the complaint being given to him, it was not possible for him to
adequately reply to the queries. The respondent on the other hand have stated
that the enquiry has since been filed, and it was not in the interest of maintaining
harmony to the supply a copy of the complaint to the appellant.
Decision
It is only fair and just that the person complained against is informed of the
nature of complaints against him. The respondent is directed to provide a copy of
the complaint made by the RWQ, Green View Apartments to the appellant within
15 days of the receipt of this order.
The matter is disposed off accordingly.
