Facts
:
1. The appellant was heard on 22/12/2008.
2. The appellant has asked for a copy of lease agreement between the
respondent and the third party. The CPIO has replied and refused to furnish the
information u/s 8(1)(d) of the Act, on the ground that the lease agreement
contains commercial and business information.
3. During the hearing, the appellant pleaded for disclosure of information on
the ground that the lease agreement is a public document. Hence, it should be
disclosed.
Decision:
4. In the course of hearing, the appellant could not explain as to how he was
affected in the matter or as to what is the public interest in disclosure of lease
agreement between the respondent and the owner of piece of land on which a
retail outlet is operationalised. Since the desired document contains commercial
information, mainly the terms and conditions for use of the land for retail outlet
and the appellant is in no way affected, the denial of information u/s 8(1)(d) is
justified.
