Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant contended that daughter of the complainant
herself went along with co-accused Pintu. However, the applicant along with
other co-accused were falsely implicated in this case. Prayer for bail of co-
accused Mustaq has already been allowed bail on 06.04.2010 in Criminal
Misc. Bail Application No. 32776 of 2009, Case Crime no. 914 of 2009 under
Section 363/366 IPC, by another Bench of this High Court. However the
applicant is in jail since 16.10.2009.
In view of the aforesaid fact without expressing any opinion on merit, let the
applicant Shabboo be released on bail, in Case Crime No. 914 of 2009 under
Sections 363, 366 IPC, P.S. Bilsi, District Budaun on his furnishing a
personal bond and two sureties each in the like amount to the satisfaction of
the court concerned.
