J U D G M E N T
Petitioner is the owner of the vehicle bearing Reg.No.KL
11/R 8375 which was seized by the second respondent on
05.05.2010. The case of the petitioner is that he was
transporting river sand on the basis of valid permit and pass as
borne by Exts.P2 and P3 and despite production of the relevant
records, the respondents have not chosen to release the vehicle
to the petitioner, which is stated as highly arbitrary and illegal in
all respects.
2. Heard the learned Government Pleader for the
respondents as well.
3. Considering the facts and circumstances, first
respondent is directed to finalise the proceedings and pass
appropriate orders with regard to the claim for releasing the
vehicle in the light of Exts.P2 and P3 and other relevant records,
if any. Appropriate orders shall be passed as expeditiously as
possible, at any rate, within two weeks from the date of receipt
of a copy of this judgment. Petitioner shall produce the copy of
W.P.(C).No.14848 of 2010 ::2::
the judgment along with a copy of the writ petition before the
first respondent for taking further steps.
Writ petition is disposed of as above.
