03 30.06.2011 Heard learned counsel for the petitioner as well as
learned Additional Public Prosecutor for the State.
Petitioner being husband of the deceased is
languishing in jail custody since 27.11.2010.
It is alleged that petitioner as well as his other
family members committed murder of the deceased for lust of
dowry but submission on behalf of the petitioner is that deceased
died of snake bite and when real fact came to the notice of the
informant, he stated the above stated fact before the trial court. It
is further contended by learned counsel for the petitioner that it
is admitted case of the prosecution that deceased was taken to a
clinic of doctor for treatment by the family members of the
petitioner and subsequently, some family members of the
petitioner were arrested by the police.
It would appear from perusal of the case diary as
well as from submission of learned Additional Public Prosecutor
that in course of investigation, some witnesses stated that
deceased herself consumed poison and after that she was taken
to hospital by her in-laws. Moreover, in course of trial, the story
of demand of dowry has not been supported either by informant
or by his son.
Therefore, considering the aforesaid facts and
circumstances as well as submissions of the parties, let the

petitioner be released on bail on furnishing bail bonds of Rs.
10,000/- (Ten Thousand) with two sureties of the like amount
each to the satisfaction of Chief Judicial Magistrate, Sheikhpura
in connection with Barbigha (Keoti O.P.) P.S. Case No. 184 of
2010
