Learned counsel for the applicant is permitted to correct the name of the
applicant.

Supplementary affidavit filed today is taken on record.

Heard learned counsel for the applicant and learned A.G.A. appearing for the
State.

It is contended by the learned counsel for the applicant that the applicant has
been falsely implicated in this case. It is further contended that the FIR was
lodged after four months and seven days from the date of occurrence and the
name of the applicant came in the confession made by co-accused Pankaj and
Amit and thereafter recovery of a rope has been made on the pointing out of
the applicant. Human bones were also recovered on the pointing out of the co-
accused. It is further contended that co-accused Pappu alias Manish Kumar
Vishwakarma has been allowed bail by the Sessions Judge.

Learned A.G.A. contended that the name of the applicant came in the
confessional statement of the co-accused and one rope was also recovered.

The case is based on the circumstantial evidence. The name of the applicant
came in the confessional statement of the co-accused. Applicant is in jail since
27.3.2010.

Considering the facts and circumstances of the case and submissions made by
the learned counsel for the applicant and without expressing any opinion on
the merits of the case, the applicant is entitled to be released on bail.

Let the applicant Shailesh Singh involved in Case Crime No. 254 of 2010
under Sections 364, 302, 201, 120-B IPC Police Station Rajapur, District
Chitrakoot be released on bail on his furnishing a personal bond with two
sureties each in the like amount to the satisfaction of the court concerned.
