2 20.12.2010 Heard learned counsel for the petitioner as well
as learned counsel for the state.
Petitioner seeks his bail in connection with
Khazekalan P.S. Case No. 103 of 2009 corresponding to
Sessions Trial No. 1545 of 2009 registered under sections-
302, 120B/34 of the Indian Penal Code and section 27 of the
Arms Act.
It would appear from perusal of the FIR itself, that
the petitioner was only a member of unlawful assembly and
it was co-accused, Raja Mian who opened fire which hit the
deceased.
Considering the facts and circumstances of the
case as well as submissions of the parties, the petitioner,
namely, Shajad @ Pappu is directed to be released on bail
on furnishing bail bond of Rs 10,000/- (ten thousand) with
two sureties of the like amount each in connection with
Khazekalan P.S. Case No. 103 of 2009 corresponding to
Sessions Trial No. 1545 of 2009 to the satisfaction of Addl.
Sessions Judge, Patna City.
