Heard learned counsel for the petitioner and learned A.P.P. for the
Prosecution.
Petitioner has been made accused for the offence under Sections
420/406/409/467/468/471/120B of the Indian Penal Code, in connection with
Madhupur P.S. Case no. 136 of 2009, corresponding to G.R. No. 307 of 2009.
The case relates to illegal withdrawal of Rs.9,58,000/- relating to Indra
Awash Yogna. From the FIR, it appears that the said amount was withdrawn by
98 unauthorized persons.
Learned counsel for the petitioner submitted that petitioner has not been
named in the FIR and the other co-accused persons have been granted bail.
Accordingly, learned counsel prays for bail.
Learned A.P.P. opposed the prayer of bail stating that the co-accused have
stated before the police that on instigation of this petitioner, they had withdrawn
the money.
In the facts and circumstances of the case, I am inclined to release the
petitioner on bail. Accordingly, the petitioner Shambhu Das is directed to be
released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand)
with two sureties of like amount each to the satisfaction of learned S.D.J.M.
Madhupur at Deoghar, in connection with Madhupur P.S. Case no. 136 of 2009,
corresponding to G.R. No. 307 of 2009.
