Heard learned counsel for the applicants, learned A.G.A and
perused the record.
Learned counsel for the applicants submitted that the plot in
question belonged to the applicant and was recorded in the
name of the applicant. In fact the applicants were assaulted
by the other side. They were aggressor. However, the report
of the applicants was subsequently registered as a cross case.
Both sides have received injuries. There was no injury
caused by Pharsa to the other side. However, the applicants
are in jail since 7.8.2009.
In view of the above, without expressing opinion on merit, let
the applicants Shanker and Surendra be enlarged on bail on
his furnishing a personal bond with two sureties each in the
like amount to the satisfaction of the court concerned in Case
Crime No. 299/09 under Section 308, 323 I.P.C. PS District
Varanasi.
