ORDER

Heard
learned advocate for the petitioner, who is before this Court being
aggrieved by order and award dated 10th
May 2010 passed by the learned Judge of the Labour Court No.1,
Bharuch in Reference (LCB) No.330 of 2004.

The
learned advocate for the petitioner invited attention of the Court to
the relevant discussion in award, in para 8. The learned advocate for
the petitioner is not able to dislodge the finding recorded by the
learned Judge of the Labour Court relying on the decision of the
Hon’ble the Apex Court in the matter of Bangalore Metropolitan
Transport Corporation Vs. T.V. Anandappa, reported in 2009
LLR 659 and decision of this Court in the matter of GSRTC,
through General Manager Vs. Fatehsinh Chhatrasinh Raj,
reported in 2003 (3) G.L.H. 640, to prove that it is incorrect or
illegal. Besides, the learned Judge has given reasons for not
exercising jurisdiction under sec.11A of the Industrial Disputes Act,
1947.

2. In
view of the above the Court finds no substance in the petition. The
petition is dismissed.
