ORDER

The
basis of the present petition is non-compliance of the order dated
9.9.2008 passed by this Court in Special Civil Application No.6178
of 2008.

Pursuant
to the notice issued by this Court, Ms.Manisha, learned AGP has
placed on record the order dated 17.8.2010 issued by the Dy.
Secretary, Gujarat Gaun Seva Pasandgi Mandal, whereby the
compassionate appointment has been offered to the petitioner on the
post of sweeper at Smt. Maniben Amratlal Hargovandas Sarkari
Ayurvedic Hospital, Ahmedabad. It has been stated that the the
order is subject to the orders, which may be passed by the Apex
Court in the event the SLP is filed by the State Government before
the Apex Court. It has also been stated by the learned AGP under
the instructions of Mr.Hasmukh Prajapti, Under Secretary of Animal
Husbandry Department, that the formal order shall be issued to the
petitioner within one week from today for offering appointment on
the basis of the present order. The petitioner shall be at liberty
to join the duty at the place on 1.9.2010 on the post of sweeper.

In
view of the aforesaid declaration, further cause for the petitioner
would not survive and shall stand disposed of accordingly. Liberty
to revive the petition in case of any of the declarations is not
complied with.
