Learned AGA files Counter affidavit which is taken on record. Heard
learned counsel for the applicant, learned A.G.A. for the State as well as perused the
record..
The accused-applicant Shesh Kumar is involved and detained in Case Crime No
135 of 2009 under Sections 498-A, 304-B, I.P.C.,& ¾ D.P.Act from Police Station
Kurwar, District Sultanpur and he has applied for bail.
The submission of the learned counsel for the applicant co accused Smt. Shanti
Devi mother in law of the deceased and Binod Kumar the brother in law (Jeth) of the
deceased have already been ordered to be released on bail vide order dated 9.12.09
passed by another bench by this court Crl. Misc. Case No. 8477 (B) of 2009. The
accused applicant is the brother in law (Devar) of the deceased whose case is identical
to case of co accused who have already been ordered to be released on bail therefore
present accused applicant also deserves to be released on bail.
The learned counsel opposed the bail application.
Considering the submission learned counsel for the applicant and learned AGA
keeping in view of the fact that mother in law, brother in law (Devar) have already been
ordered to be released on bail. Therefore present accused appellant may be also
ordered to be released on bail. The bail application is allowed.
Let the accused applicant Shesh Kumar be enlarged on bail and on his executing
personal bond with two sureties each in the amount to the satisfaction of Chief Judicial
Magistrate Sultanpur.
