It is submitted that the evidence of so-called eye witness

is inconsistent with what is stated in the first information report.

Be that as it may, as appellant has already been in

custody for over six years, he is directed to be released on bail on his

furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two

sureties of the like amount each to the satisfaction of Additional

Sessions Judge, Fast Track Court No III, Madhubani in Sessions

Trial No 92 of 1997.

Realization of fine shall also remain stayed during

pendency of the appeal.
