Heard learned counsel for the applicant and learned A.G.A. appearing for the
State.
It is contended by the learned counsel for the applicant that the applicant is
mother-in-law of the deceased. There is general allegation against her and she
has been falsely implicated in this case. No overtact has been assigned to her.
Father-in-law of the deceased has already been allowed bail by this Court.
Sri PP Shukla Advocate holding brief of Sri KD Tripathi, learned counsel for
the complainant contended that the accused persons after committing murder
of the deceased forcibly obtained signature of the complainant on the plain
papers and this application has been filed along with counter affidavit.
Learned A.G.A. supported the arguments of the learned counsel for the
complainant.
Applicant is mother-in-law of the deceased. No overtact has been assigned to
her. She is in Jail since 29.8.2009.
Considering the facts and circumstances of the case and submissions made by
the learned counsel for the applicant and without expressing any opinion on
the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Shivpatti Devi involved in Case Crime No. 354 of 2009
under Sections 498-A, 304-B IPC & Section 3/4 D.P.Act, Police Station
Handia , District Allahabad be released on bail on her furnishing a personal
bond with two sureties each in the like amount to the satisfaction of the court
concerned.
