What
is challenged in the present Special Civil Application under Article
227 of the Constitution of India is the order passed by both the
courts below with respect to standard rent under sec.11 of the
Bombay Rent Act.
Heard
the learned advocate appearing on behalf of the respective parties.
Mr.S.M.
Shah, learned advocate appearing on behalf of the petitioners has
submitted that the observations made by the both courts below might
come in the way of the petitioners at the time when the suit is
filed for getting decree of possession under the Bombay Rent Act.
It
is to be noted that as and when the suit for eviction is filed, the
same shall be decided in accordance with law and on its own merits,
and in light of the evidence which may be brought on record and on
appreciation of the same and without in any way being influenced by
the observations made by both the courts below while considering the
application under sec.11 of the Bombay Rent Act.
With
these, the present Special Civil Application is disposed of.
