Background
1. The Applicant filed an RTI application dt.15.4.09 with the CPIO, CGHS,
Mumbai. He requested for information against 10 points with regard to
medical reimbursement claims received directly from the beneficiaries.
The CPIO replied on 15.5.09 stating that information sought for last 3
years is exhaustive and that it will take time to collect the information.
On 26.5.09 the CPIO requested the Applicant to pay Rs.1152/- towards
supply of 576 pages of information. The Applicant filed an appeal
dt.8.6.09 stating that CPIO’s replies are evasive and reiterated his
request for the information. The Appellate Authority gave a speaking
order on 16.6.09 directing the CPIO to supply the information to which
the CPIO replied on 9.7.09. Being aggrieved with the reply, the
Applicant filed a second appeal dt.3.8.09 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner,
scheduled the hearing on October 5, 2009.
3. Dr. S.S.Savale, CMO (NFSG) represented the Public Authority.
4. The Applicant was not present during the hearing.
Decision
5. The Commission noted that information sought is indeed exhaustive
and that despite the voluminous information he had to collect, the
Respondent has managed to collect monthwise amount of medical
reimbursement claim for the given period against points 1 & 2 of the
RTI request. With regard to the query in the second appeal regarding
processing of claims before 21.10.08 for those claims received upto
10.9.08, the Commission directs the CPIO to provide a certified copy of
the MRC register indicating payments chronologically. The Commission
noted that information against pt.5 of the RTI request has been
provided and directs the CPIO to provide information against pt.6 as
sought by the Appellant. The information to be provided by 10.11.09.
6. The appeal is accordingly disposed of.
