JUDGMENT

1. Shri A.K. Singh has come with an appeal before the Commission against the order dated 13.12.2005 of the CPIO, Shri M.S. Upadhye, CPIO, Addl Commissioner of Police and order dated 4.2.2006 of the Appellate Authority, Shri Qamar Ahmed, Jt. Commissioner of Police.

2. The appellant through his request dated 2.11.2005 sought the following information from the CPIO List of all the ACPs & concerned Staff of Delhi Police who are/were the member of Raiding Team, Headed by ACP/S.D.M. as directed by Honble Supreme Court of India dt 20.11.1997.

3. The reply of the CPIO dated 8.11.2005 states the following:

This is with reference to your letter dated 02.11.2005, on the subject cited above. In this regard I am to inform you that you may kindly refer to para-g page No. 4 of the Supreme Court order passed in W.P No. 9300/82, 039/98, 95/97 in I.A Nos. 7, 8, 9 & 10 in WP (C) No. 13029/85 dated 20.11.97, copy enclosed for ready reference The flying squads were formed under leadership of SDMs and not the ACsP/Traffic, as mentioned by you in your application The details of such teams are not available with us. You may kindly contact the office of Divisional Commissioner, i.e concerned D.C. for obtaining information regarding flying squads formed under the orders of Honble Supreme Court of India. All ACsP/Traffic and other officers of traffic police have powers under the M.V Act ACsP have also been empowered by STA to take action under Section 86(4) M.V. Act in pursuant of directions of Honble Supreme Court of India.

4. The matter was heard on 7.7.2006 The appellant was present in person while the Public Authority was represented by Shri Qamar Ahmed, Appellate Authority, Jt. Commissioner of Police (Traffic).

It emerged from the hearing that the appellant has certain impression about how the respondents ought to comply with a certain order of the Supreme Court in WP No. 9300/82, 039/98, 95/97 in IA Nos. 7, 8, 9 and 10 in WP(C) No. 13029/85 dated 20.11.1987. The reply of the CPIO has adequately explained why the request of the appellant cannot be complied with because the Delhi Traffic Police has complied with the orders of the Supreme Court within the Traffic Polices own norms of work and functions.

6. The appeal is rejected.
