Facts

:

1. Both the parties were heard on 9/11/2009.

2. The appellant has asked for certain information relating to the Companies
(two), which are under liquidation. Being not satisfied with the CPIO response,
the appellant has submitted two separate appeals, which are examined together.

3. During the hearing, the details of information asked for and the CPIO’s
response were discussed. The appellant alleged that he has clearly specified the
required information, which has not been furnished to him. The appellant also
said that the respondent has not provided the necessary support to inspect the
relevant files and records containing the information.

4. The CPIO stated that the information asked for relate to the old records of
1984, some of which are not properly maintained or preserved. The
respondents, however, agreed to cooperate and allow inspection of complete
records and files.

Decision:

5. As agreed between the parties, the CPIO would allow inspection of the
relevant documents to enable the appellant to specify the required information,
which should be furnished to him.

6. As regards the specified information in the RTI application dated April 1 &
2, 2009, the CPIO would clearly indicate as to which information are not available
or preserved in full or part.

7. Since the matter is already before the Court for adjudication and the Court
has full control over the entire records required for providing legal relief to the
parties, it is hoped that the appellant’s grievances would be redressed.

8. With these observations, the appeal is disposed of.
