Facts
:
1. The complaint was scheduled for hearing on 19/3/2009. But, the
complainant did not avail of this opportunity.
2. On perusal of the documents submitted by the complainant, it is observed
that the CPIO has furnished partial information, while the remaining information,
mainly the evaluated answer sheet, score of marks, merit list, etc., in respect of
an examination conducted by the respondent, have been refused on the ground
of confidentiality of the documents.
3. Being not satisfied with the response, the complainant has pleaded for
providing complete information.
Decision:
4. The conduct of examinations for recruitment and selection of staff has to
be fair and transparent. There should also be a system in place to demonstrate
that such processes are conducted in an objective and transparent manner.
Accordingly, the public authorities are required to put in public domain the entire
process of conduct of examinations and interviews after the selection process is
complete and over.
5. In view of this, denial of information relating to evaluated answer sheet,
score of marks in written as well as personal interviews, merit list, etc., is not
justifiable on such grounds as confidentiality of documents. The CPIO is,
therefore, directed to furnish the information asked for within 15 working days

from the date of issue of this decision, failing which penalty proceedings u/s 20(1)
of the Act would be initiated.
6. With these observations, the appeal is disposed of.
