Background
1. The Applicant filed an RTI application dt.17.10.07 with the PIO & Sr.DCM,
East Central Railway, Mughalsarai. He stated that on 31.10.03, there was
restructuring of vacant posts relating to ‘Checking’ category because of which
some posts have been increased and several employees have been promoted.
Also according to him in the year 2005, selection process for Head Ticket
Examiner had been initiated and even after 2 years, it has not reached its
finality. In the context of these issues, he sought information against 14
points. The PIO replied on 8.11.07 providing point wise information (Copy
not in file). Not satisfied with the information, the Applicant filed an appeal
dt.22.10.08 with the Appellate Authority seeking additional information. The
Appellate Authority replied on 6.1.09 informing him that the RTI application
was responded to by the PIO on 8.11.07 and that all his letters dt.28.12.07,
17.3.08 and 28.4.08 seeking clarification have also been responded to. He
informed that the Applicant that he is seeking additional information in his
first appeal and requested him to file a fresh RTI application for the new
information. Being aggrieved with this reply, the Applicant filed a second
appeal dt.10.6.09 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for March 31, 2010 through video conferencing.
3. Shri L.K.Rai, Chief OS and Shri Rishikesh Kumar, Head Clerk represented the
Public Authority . They were present at NIC Studio, Varanasi while the
Applicant was not present.
Decision
4. The Commission after reviewing the submissions on record holds that
complete information has been provided to the Appellant and advises the
Appellant to file a fresh RTI application for seeking additional information and
accordingly disposes of the appeal.
