FACTS

:-

By his letter of 28/07/2006, the complainant had requested for copies of
Registered Deed and other related documents in respect of Bay Shop No.225, Sector
29D, Chandigarh. The CPIO, vide his letter dated 01/09/2006 denied the information on
the ground of third party objection. The Appellant did not file Appeal before the First
AA and chose to file the present complaint before the Commission

2. The matter was heard on 21/11/2008. The Appellant appeared in person. The
Public Authority is represented by officers mentioned above. During the hearing, the
complainant submits that he did not file First Appeal as no AA was in position at that
time. Shri Ashwani Kumar submits that presently he is the AA.

DECISION

3. In view of the above, the case is remanded to Shri Ashwani Kumar, Assistant
Estate Officer, UT of Chandigarh (FAA), to decide the case, in next four weeks time, in
terms of the relevant provisions of the RTI Act.

4. The matter is disposed of accordingly.
