Background:
 Shri Bhagwan K. Chandnani of Mumbai filed an RTI-application with the Public
Information Officer, Ministry of External Affairs, New Delhi on 14 February 2008
wherein he sought passport details of two individuals.
2. The PIO vide his letter dated 28 February 2008 replied to his RTI-application.
Not satisfied with the reply of the PIO, the Appellant filed an appeal with the first
Appellate Authority on 10 March 2008 who vide his letter dated 24 March 2008
replied to it. Thereafter, the Appellant approached the Commission with a Second
Appeal on 15 July 2008, which was registered in the Commission on 18/08/2008.
3. The Bench of Dr. O.P. Kejariwal, Information Commissioner, heard the matter
on 17 October 2008.
4. Shri R.N. Kajla, US (CPV-RTI) & PIO, represented the Respondents.
5. The Appellant, Shri Bhagwan K. Chandnani, was present in person.
Decision:
6. The Commission heard both the sides and broadly agreed with the submission
of the Respondent that the information asked for by the Appellant about two
individuals was purely a personal matter constituting third party information. During
the hearing, the Appellant, however, alleged certain irregularities on the part of the
persons about whom he was asking for information. The Commission drew his
attention to the provision of the Act whereby the third party clause could be
overridden in case there was any public interest involved. The Commission,
therefore, gives one more opportunity to the Appellant to make his submission in
writing to establish that the matter has an element of public interest and was not
merely a case of a private dispute. This should be made by 14 November 2008. In
case no communication is received from the Appellant by that date, the matter will
be treated as finally closed.
7. The Commission ordered accordingly.
