This matter was scheduled to be heard on 14.07.2009 through
videoconferencing for which notices were issued to the appellant,
Shri D. Mukherjee and the respondents on 18.06.2009 asking them to be
present at NIC Studio at Dhanbad. Appellant was absent when the
hearing commenced, while the respondents were present at NIC Studio,
Dhanbad. Commission conducted the hearing from its New Delhi office.
2. It is seen from the RTI-petition of the appellant that what he
sought through his RTI-queries was explanations, reasons, etc. from the
respondents. As rightly held by the Appellate Authority in his decision
dated 01.04.2009, these do not qualify to be information under Section
2(f) of the RTI Act and as such, no obligation can be cast on the
respondents to respond to it.
3. That being so, it seemed that respondents have attempted to
provide to the appellant some response to the queries in his RTI-
application. A written-submission has also been received from the
Bharat Coking Coal Limited through their P.M. (IR/Legal), Dr.H.Kishore.
4. It is directed that a copy of the said response may be sent to the
appellant for his information.
5. Appeal disposed of with these directions.
6. Copy of this direction be sent to the parties.
