Facts
By his letter of 24.8.2007, the appellant had made the following
request to the CPIO :-
“Kindly refer to Ministry of Urban Development (Delhi Division),
Government of India’s Notification No. S.O. 1456(E) dated 7.9.2006
read with corrigendum No. S.O. 1511 (E) dated 14.9.2006 and furnish
the following information under section 7 of the RTI Act, 2005 :-
i. Whether the Shops (except prohibited ones with non-
permissible uses) functioning in residential plotted
development and group housing on streets/areas notified as
commercial by the Government of NCT of Delhi in pursuance
of the Government of India’s Notifications referred to above
shall be treated as regularized and considered Local Shopping
Centers after getting registered and payment of special
Conversion charges fixed by the Central Government; and
ii. It is presumed that the shops referred to at (i) above on the
commercialized streets/areas shall be permitted to function for
purpose of more flexible land use without unduly rigid
restrictions regarding the floors from which they operate as
recommended by Shri Tejinder Khanna Committee.”
2. The CPIO by his letter dated 27.12.2007 had informed the
appellant, that the relevant information was covered under chapter 15.0
within “Mixed Use Regulation” in sub paras 15.4, 15.5, 15.9 & 15.12 of
MPD-20201.
3. On appeal having been filed, the Appellate Authority vide letter
dated 19.2.2008 had asked the appellant to visit his office for any further
clarifications.
4. The present appeal has been filed against the order of the
Appellate Authority.
5. The matter was heard on 19.12.2008. The appellant did not
appear before the Commission. DDA is represented by officer
mentioned above. Smt Bawa would submit that in addition to the paras
mentioned by CPIO, another relevant para in this regard is 15.3 and that
all these paras contain the relevant information as requested for by the
appellant. She would also submit that some modifications have been
made in MPD 2021 and that she would send a fresh reply to the
appellant intimating updated position to him.
DECISION
6. In view of the above, Smt Bawa is directed to furnish requisite
information to the appellant in next 3 weeks time.
7. The matter is disposed of accordingly.
