This matter came up for hearing on 05.02.2009 in the presence of both
parties.
2. Respondents pointed out that the appellant is an employee of the public
authority and the queries he has raised through his RTI-application dated
26.06.2008 are related to a host of information which were in the nature of
explanations about the actions of the public authority. They argued that they
were not obliged to furnish this information to the appellant insofar as it is not
within the scope of Section 2(f) of the RTI Act.
3. It is noted that this appellant is one of the many employees of public
authorities who have used the RTI Act to sub-serve their personal ends. For
example, this petitioner has asked for information about the complaints which
have been received by his employers, viz. the LIC of India from all sources
against him from the time he has entered service. He has, through these queries,
painted several scenarios, to which he has demanded that the respondents should
react.
4. It is a point that needs to be debated, i.e. whether employees of public
authorities should be allowed to breach the boundaries of discipline and personal
conduct in the name of asking RTI-queries. Commission will have to take a
stand in matters such as this one time or the other.
5. I find that the queries which the appellant has raised do not meet the test
of the definition of information contained in Section 2(f) of the RTI Act.
No responsibility can be cast on the respondents to answer these queries.
6. Appeal dismissed.
7. Copy of this decision be sent to the parties.
