Background
1. The Applicant filed an RTI application dt.11.12.08 with the PIO, Eastern Railway HQ,
Kolkata. He stated that an S.E./W.S. had been declared suitable and promoted to the
post of S.S.E/W.S. but again posted and re-designated as S.S.E/Store. In this
context, he requested for information against 5 points. Dr.K.C.Bal, PIO & Chief
Personnel Officer(A) replied on 22.1.09 furnishing point wise information. Not satisfied
with the reply, the Applicant filed an appeal dt.20.2.09 before the CIC requesting the
Commission to forward the same to the Appellate Authority as the PIO’s reply did not
contain the name and address of the Appellate Authority..
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing
for March 9, 2010 through video conferencing.
3. Shri P.K.Mitra, CPIO and Shri T.C.Mukherjee, Nodal Officer representing the Public
Authority were present at NIC Studio, Kolkata while the Appellant was not present.
Decision
4. The Respondents submitted that the Appellant had not filed his appeal to the First
Appellate Authority and that on receipt of the appeal from the Commission along with
the hearing notice, Shri A.K.Gupta, Appellate Authority had replied on 5.3.10. The
Respondents further added that after having noted the complaint of the Appellant
about not having been provided with details of the Appellate Authority to whom he can
appeal, a circular had been issued to all the Public Authorities under the Eastern
Railway directing them to provide such details without fail as it is mandatory .
5. The Commission after hearing the submissions made holds that complete information
has been provided to the Appellant and disposes of the appeal.
