1. The appeal was scheduled for hearing on 24/6/2010. But, the appellant
did not avail of the opportunity of personal hearing. The appeal is, therefore,
examined on merit.

2. The appellant has asked for a copy of DPC’s recommendations for
selection/promotion of Junior Officers. The CPIO has refused to furnish the
information without indicating the provisions of the Act under which the
information is refused to the appellant.

3. Being dissatisfied with the CPIO’s response, the appellant had filed his fist
appeal before the Appellate Authority of the respondent, who, in turn, remanded
back the case to the CPIO. Accordingly, the CPIO has furnished part of the
information and the remaining information has been refused on application of
section 10(1) of the Act. In his appeal before the Commission, the appellant has
pleaded for providing complete information.

Decision:

4. In a number of cases, this Commission has directed the public authorities,
including the respondent, to put in public domain all the DPC minutes so as to
demonstrate objectivity and fairness in the selection process. In the matter of
disclosure of DPC minutes, there is no justification for application of Section
10(1) of the Act for withholding the information relating to the process of selection
and promotion of staff.

5. The CPIO is, therefore, directed to furnish complete documents in respect
of the recommendations of DPC within 15 working days from the date of receipt
of this decision.

6. With these observations, the appeal is disposed of.
