Background:
Shri Dinesh Kumar Khatnal of Jaipur filed an RTI-application with the
Public Information Officer, North Western Railway, Jaipur, on 20 December
2007, seeking information relating to some service matters.
2. The PIO vide his letter dated 5 February 2008 replied to the RTI-
application. Not satisfied with the reply of the PIO, the Applicant sent another
letter to the CPIO on 5 February 2008 and then approached the Central
Information Commission with a Second Appeal on 21 May 2008 which was
registered as a complaint in the Commission on 26 June 2008.
3. The Bench of Dr. O.P. Kejariwal, Information Commissioner, heard the
matter on January 2009.
4. Shri Rupesh Singhvi, Sr. DFM & PIO, Shri H.S. Prajapati, Sr. DPO and Shri
V.K. Sharma, represented the Respondents.
5. The Complainant, Shri Dinesh Kumar Khatnal,was neither present nor
send any representative for the hearing.
Decision:
6. In the absence of the Appellant, the Commission heard the Respondents
and noted that they had given a point-wise reply in time to the RTI-application
of 20 December 2007. They also stated that they had not received any First
Appeal from the Appellant. On the Commission’s file, however, there is a copy
of a First Appeal but again marked to the CPIO only. The Commission,
therefore, directs the Appellant to point out the lacunae that he finds in the
Respondent’s reply and first file his First Appeal.
7. The case is thus disposed of.
